Terms and Conditions

The rules for using the Site and the designer. Custom builds are governed by their own written agreements.

Last updated: 31 October 2026

1. About these terms

This website, builddesign.solutions ("the Site"), and the Build Design Solutions designer ("the designer") are operated by Directory.com.au Pty Ltd (ABN 68 090 816 461) ("we", "us", "our"). By using the Site or the designer you agree to these terms. If you do not agree, please do not use them.

2. What the designer is, and is not

The designer produces concept-stage building options, areas, quantities, costs, feasibility figures and engineering estimates from the inputs you give it and from public data sources. Every result is indicative: an aid for comparing options early, not a planning assessment, a Building Code or Australian Standard compliance certificate, a structural, geotechnical, hydraulic, mechanical, electrical or fire engineering design, a cost plan, a valuation or financial advice. Planning controls, cadastral boundaries and terrain come from third-party services and may be incomplete, out of date or wrong. Engage the qualified professionals for your project before relying on any figure, and check every control against the planning instrument that applies to your site.

3. Access to the designer

Access is granted on request, at our discretion, and may be free, limited to invited users, or offered on paid terms that we tell you about before you are asked to pay anything. Where a paid subscription is in place it is billed in advance by card through Stripe and renews until you cancel on your account page; cancelling stops the next renewal, access continues to the end of the period already paid for, and we do not refund part-months. Free or invited access can be changed or withdrawn at any time. Your account is for you: do not share sign-in links or codes.

4. Your designs and uploads

You own the designs you create and the files you upload. You give us the licence we need to store, process and display them to run the designer and, for Pro accounts, to build the private version you asked for. You are responsible for having the rights to anything you upload, including surveys, drawings and photographs. Designs stay in your browser; we do not back them up. Export the projects you care about.

5. Acceptable use

  • Do not use the Site, the designer or its forms to send unlawful, misleading, malicious or infringing material.
  • Do not attempt to interfere with the operation of the Site or the designer, probe or test their security without written authorisation, scrape or bulk-query the lookup services through them, or submit automated requests.
  • We may block access or discard submissions that breach these rules.

6. Quotes and engagements

Submitting a form does not create a contract. Custom builds and other services are subject to a separate written proposal or agreement setting out scope, price, timelines, data handling and intellectual property. If there is any inconsistency between these terms and an engagement agreement, the engagement agreement prevails.

7. Intellectual property

The Site, the designer and their content (software, text, design, logo, graphics, videos and documentation) are owned by or licensed to us. You may use the designer for your own projects and share links to the Site; you may not copy, resell, reverse engineer or commercially exploit the designer or its content without our written permission. Third-party product names mentioned on the Site are trademarks of their owners; their use indicates interoperability, not endorsement or affiliation.

8. Liability

To the maximum extent permitted by law, we exclude all liability for loss or damage arising from use of the Site or the designer or reliance on their results. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other legislation that cannot lawfully be excluded. Where liability cannot be excluded but can be limited, our liability is limited, at our election, to resupplying the relevant service or paying the cost of resupply.

9. Third-party services and links

The designer relies on public and third-party services (map, cadastre, planning, terrain and AI providers) that we do not control and that may change or become unavailable. The Site may link to external websites; we are not responsible for their content or practices, and a link is not an endorsement.

10. Privacy

Our handling of personal information is described in the Privacy Policy, which forms part of these terms.

11. Changes

We may update these terms at any time by publishing the revised version on this page. Continued use after a change constitutes acceptance.

12. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
